Elements2Balance collects and processes your personal data in accordance with data protection regulations. Information about data processing, the purposes and your rights can be found in this privacy policy.

1. name and contact details of the person responsible

The platform elements2balance.me is responsible for the collection of personal data.

2. visit our website

When you visit our website, the following access data is automatically collected by our system and temporarily stored in a so-called log file:

  • the IP address of the computer you are using,
  • Date and time of your visit,
  • the Internet pages that you visit on our website,
  • the website from which you accessed our website (referrer),
  • the browser type and version you are using and
  • the operating system of your computer.

This data is used to ensure the connection to our website is established, to guarantee system security and to optimize our website. Under no circumstances do we use the access data to establish a connection to your person.
The legal basis for this data processing is Art. 6 para. 1 sentence 1 f of the EU General Data Protection Regulation (GDPR).
Our legitimate interest in data processing arises from the aforementioned purposes.
The data will be deleted as soon as it is no longer required for the stated purposes. The data required to establish a connection to our website is deleted when you end your visit to our website. Otherwise, the data in the log files will be deleted after seven days at the latest.

3. TLS encryption

We use the TLS (Transport Layer Security) encryption method on our website. This procedure corresponds to the current state of the art and serves to protect your personal data from access by third parties during transmission.

4. contact

You can reach us by phone, e-mail or Contact formmail. Personal data such as your e-mail address is processed for the purpose of communication. When using the contact form, the data is processed as shown on the form. The data will be stored for the purpose of processing your request and deleted as soon as your request has been dealt with and you have not given us your express consent to further use. The legal basis for data processing is our legitimate interest in responding to inquiries in accordance with Art. 6 para. 1 sentence 1 f) GDPR.

If your request is made for the purpose of concluding a contract, the data will also be processed to carry out pre-contractual measures or to fulfill the contract in accordance with Art. 6 para. 1 sentence 1 b) GDPR (see section 5).

5. execution of the contract

We process your data for the performance of the contract and for the implementation of corresponding pre-contractual measures, in particular for the purpose of providing our services for members of our platform and for the organization of workshops and seminars. For this purpose, we process personal data such as your name, address, e-mail address, telephone and, if applicable, fax number. If you use our forms (e.g. registration form), we process the data as shown on the forms.
If we have not received separate consent, this data will only be processed to fulfill the contract or carry out pre-contractual measures in accordance with Art. 6 para. 1 sentence 1 b) GDPR. After the contract has been processed, the data will be deleted, provided that there are no legal regulations, for example tax and commercial law retention obligations, to the contrary and you have not given us your express consent to further use.
Your contract data will only be passed on to third parties if this is necessary for the processing of the contractual relationship with you in accordance with Art. 6 para. 1 sentence 1 b) GDPR.
Your payment data will be processed by the payment service provider commissioned with the payment for the purpose of processing your order (see section 6).

Payment processing, credit check

Stripe

The payment methods credit card, direct debit, iDEAL, Google Pay and Apple Pay are processed via Stripe, a payment service of Stripe Payments Europe, Limited, The One Building, 1, Lower Grand Canal Street, Dublin 2, Ireland.
For the purpose of payment processing, Stripe collects your order data (name, address, e-mail address, telephone number, payment method, date and payment amount of the transaction) as well as your credit card data for payment by credit card or your bank details for payment by direct debit.

Protection against fraudulent activities, credit check
Stripe also uses your transaction data to detect and prevent fraudulent activity against Stripe and us, including detecting unauthorized logins using your online activity. Stripe may provide us and other business users (including card issuers and others involved in payment processing) with personal information about you (including your attempted transactions) so that the fraud risk associated with the transaction in question can be assessed.
Stripe may compare your data with databases of credit agencies for the purpose of identity and credit checks. Your address, account and card data will be transmitted to the credit agency. The data is stored by the credit agency and can be used by the credit agency to determine your solvency and willingness to pay in the form of scoring values, among other things. The calculation of the scoring value is based on a mathematical-statistical procedure. For example, personal and demographic data can be used for this purpose. If the credit check is negative, the selected payment method is not possible. You will be informed of this immediately. You can find out which credit agencies are commissioned by Stripe with the data comparison on request from Stripe.

The legal basis for data processing and disclosure for the purpose of credit checks and fraud prevention is Art. 6 para. 1 sentence 1 b) and Art. 6 para. 1 sentence 1 f) GDPR. The legitimate interest lies in the prevention of payment defaults. You have the right to object to data processing for the purpose of credit checks vis-à-vis Stripe under the legal requirements.

Insofar as Stripe processes data in the USA, this is done on the basis of standard contractual clauses pursuant to Art. 46 (2) c) GDPR, which have been approved by the European Commission. Google Payments (Google Pay)

For payment with Google Payments (Google Pay), a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, the payment cards (credit, debit card) you have stored in the Google Pay app are used for payment. You can also pay via a digital wallet or via an account of another company that you have linked to Google Pay ("third-party provider", e.g. PayPal). To complete the payment process, you confirm the payment instruction using the authentication methods offered by Google Pay (e.g. fingerprint, PIN or security code). Google Pay arranges for a virtual or other uniquely generated card number corresponding to your registered means of payment to be sent to us. However, the actual number of your payment card is not transmitted. Another option may be made available to you via your third-party account linked to Google Pay. To process the payment, your order data, name, address and e-mail address, payment method, date and payment amount of the transaction are transmitted to Google in encrypted form.
Google may share details of your payment method and related information with third-party providers so that they can charge your payment method. For online transactions, this also includes other information required for payment processing, such as the billing, shipping or e-mail address stored in your Google Account.
Apps and websites that support the Google Pay payment method can check whether Google Pay is installed on your device in order to offer you Google Pay as a payment method. You can deactivate this disclosure in the settings of your Google account.
The legal basis for the above-mentioned data processing for the purpose of payment processing is Art. 6 para. 1 sentence 1 b) GDPR.

Google reserves the right to exchange data with its own subsidiaries for the purpose of checking your creditworthiness and to use your data by its subsidiaries for marketing purposes. Apple Pay

For payment with Apple Pay, a service of Apple Distribution International Ltd, Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, the payment data you have stored on an iOS device (e.g. iPhone) in the "Wallet" app will be used for payment. To complete the payment process, confirm the payment instruction using the authentication methods offered by Apple (e.g. fingerprint, PIN or security code).
Apps and websites that support the Apple Pay payment method can check whether Apple Pay is installed on your device in order to offer you Apple Pay as a payment method. You can deactivate this option in the privacy settings of your "Safari" browser.
To transmit the payment data, Apple Pay receives the encrypted transaction and encrypts it again before the transaction data is transmitted to the payment processor. Encryption means that only the app or website on which you place your order can access the encrypted payment data. However, Apple does not send us the actual number of your payment card.
The legal basis for the above-mentioned data processing for the purpose of payment processing is Art. 6 para. 1 sentence 1 b) GDPR.
Apple stores the transaction data in anonymized form. This includes the approximate payment amount, the name of the merchant, the approximate date and time and whether the transaction was completed successfully. Apple uses this data to improve Apple Pay and other products and services. The legal basis for this data processing is Art. 6 para. 1 sentence 1 f) GDPR. Apple's legitimate interest lies in the optimization of Apple services.
If you use Apple Pay on your iPhone or Apple Watch to confirm a purchase that you have made via the Safari browser on your Mac, the Mac and the authorization device communicate in encrypted form on Apple's servers. Apple does not retain any of this information in a format that can be used to identify you. You can object to this option in the settings of your iPhone under "Wallet & Apple Pay" by deactivating "Payments on Mac".

PayPal

To pay with PayPal, you will be redirected to the PayPal website during the ordering process, where you log into your PayPal account. Your payment data stored there will be used by PayPal for payment processing. The legal basis for payment processing is Art. 6 para. 1 sentence 1 b) GDPR.
Credit check
When paying by credit card and direct debit, PayPal compares your data with databases of external credit agencies such as SCHUFA for the purpose of identity and credit checks. The following data is transmitted to the credit agency: First and last name, address, date of birth and your account details. If necessary, PayPal also transmits information about non-contractual or fraudulent behavior on your part. The data is stored by the credit agency and can be used by the credit agency to determine your solvency and willingness to pay in the form of scoring values, among other things. The calculation of the scoring value is based on a mathematical-statistical procedure. For example, personal and demographic data can be used for this purpose. 7. registration and member account

To register on our platform, please provide the mandatory information as shown on the registration form. This includes in particular

  • First and last name
  • Your e-mail address
  • Self-selected profile name, if applicable
  • Self-selected password and
  • Telephone number and further information if necessary

Once you have registered, we will create a password-protected member account for you, which you can log into using your e-mail address and password. Your password is not visible to third parties. You can change your mandatory details at any time, with the exception of your name and e-mail address. If you wish to delete your name or your profile, please contact us via Support.

Member account

A profile is created for you in the member account, which displays the following information you provided during registration as a basic profile by default:

  • First and last name
  • if applicable. @profile name and
  • Telephone number and other data, if applicable

The profile is only visible to members and cannot be viewed by non-registered users of the platform, nor can it be found outside the platform.

Additional information is optional, for example:

  • Marital status
  • Hobbies
  • other information about me as a person
  • etc.

You can also voluntarily upload content such as a profile picture, date, place and hour of birth or other information about you and your life.

You can manage the data protection settings for your content yourself and decide in the settings in your member account for whom the voluntary information and content in your profile is visible, as follows:

  • all members (= community),
  • Your contacts or
  • only for yourself.

You can change, add to or delete your voluntary information and content at any time.

You can use your member account to send requests to other members if necessary.

Contact requests

You can make and accept contact requests via your member account.

Visitors:inside

You may be able to see visitors to your profile and be seen as a visitor via your member account.

The legal basis for the provision of the services described above is Art. 6 para. 1 sentence 1 b) GDPR.

8. transmission of data to third parties

Your personal data will only be transferred to third parties in the following cases:

  • You have given us your consent to this in accordance with Art. 6 (1) sentence 1 a) GDPR.
  • The transfer is permitted by law and is necessary for the processing of contractual relationships with you in accordance with Art. 6 para. 1 sentence 1 b) GDPR.
  • The disclosure is required pursuant to Art. 6 para. 1 sentence 1 c) GDPR to fulfill a legal obligation to which we are subject.
  • The disclosure is necessary pursuant to Art. 6 para. 1 sentence 1 d) GDPR in order to protect your vital interests or those of another natural person.

Cookies are used on the website. Cookies are small text files that are stored on your end device by the browser when you visit a website.

Some cookies, so-called "session cookies", are only stored for the duration of your visit to the website and are deleted as soon as you close the browser. 13th YouTube

We have embedded YouTube videos on our website to enable you to play videos quickly and easily and to make our online offering more attractive for you. Newsletter mailing

Further information (surname, first name, etc.) is voluntary and is used to personalize the newsletter (personal salutation).
To prevent misuse, you will receive an e-mail after registration with a link to confirm your registration. Only when you click on the link will you receive our newsletter in future. To prove your consent to receiving our newsletter, we log your IP address and the date and time of your registration.

You have the right to request information from us at any time about your personal data stored by us (Art. 15 GDPR).
